கடந்த 35 ஆண்டுகளாக இதர பிற்படுத்தப்பட்ட மாணவர்கள் இழந்த உரிமையை மீட்க மத்திய அரசுக்கு பாமக நிறுவனர் மருத்துவர் ராமதாஸ் கடிதம் எழுதியுள்ளார். இது குறித்து அவருடைய முகநூல் பக்கத்தில் பதிவிட்டுள்ளதாவது.

மருத்துவப் படிப்பு அகில இந்திய ஒதுக்கீட்டு இடங்களில் ஓபிசிக்கு உடனடியாக இட ஒதுக்கீடு வழங்க வேண்டும்!

பிரதமர் நரேந்திர மோடி அவர்களுக்கு மருத்துவர் அய்யா கடிதம்

மருத்துவக் கல்விக்கான அகில இந்திய தொகுப்பு இடங்களில் பிற பிற்படுத்தப்பட்ட வகுப்பினருக்கு இட ஒதுக்கீடு வழங்கத் தடையில்லை என்று சென்னை உயர்நீதிமன்றம் தீர்ப்பளித்துள்ள நிலையில், உயர்நீதிமன்றத் தீர்ப்பின்படி, தமிழக அரசின் சுகாதாரத்துறை செயலாளர், இந்திய மருத்துவக் குழுவின் செயலாளர், பல் மருத்துவக் குழுவின் செயலாளர் ஆகியோர் அடங்கிய குழுவை அமைத்து இட ஒதுக்கீடு குறித்து விரைந்து முடிவெடுக்க வேண்டும் என்று பிரதமர் நரேந்திர மோடி அவர்களை பா.ம.க. நிறுவனர் மருத்துவர் அய்யா அவர்கள் கேட்டுக் கொண்டிருக்கிறார். இது தொடர்பாக பிரதமர் நரேந்திர மோடிக்கு அவர் கடிதம் எழுதியுள்ளார்.

அந்தக் கடிதத்தின் நகலை மத்திய சுகாதாரத்துறை அமைச்சர் ஹர்ஷ்வர்தன் அவர்களுக்கு அனுப்பியுள்ளார். அந்தக் கடிதத்தின் விவரம்:

Sub: admissions to UG and PG medical courses – under All India Quota – implementation of Madras high court judgement – to provide reservation to Other Backward Classes – regarding

I am writing this letter to draw your attention regarding the judgement of Honourable Madras High Court that ordered implementation of reservation of 27% seats to Other backward classes (OBCs) for admission to undergraduate (UG -MBBS) and various postgraduate medical courses (PG) under All India Quota (ALL INDIA QUOTA).

Since you also belong to other backward classes, you are looked at as their representative and leader. We have high hopes that you can help their cause and render justice to them. Hence this letter.
As you are aware Pattali Makkal Katchi (PMK) is a political party that fights for social justice. Our party strives to achieve social justice at State and National levels. Ever since the All India Quota was created for admissions to UG and PG medical courses, the Other backward classes (OBCs) have been refused reservation. Former Minister of Health, the youth wing President of PMK and Member of Rajyasabha, Dr. Anbumani Ramadoss has written several letters to the minister of Health requesting to rectify this injustice.

Dr. Anbumani Ramadoss also filed a case in the Madras High Court pleading implementation of 27% reservation in admissions to UG and PG medical courses under All India Quota. Several other political parties in Tamil Nadu and the Government of Tamil Nadu also filed similar cases in the Madras High Court. Yesterday (27.07.2020) the Honourable Court gave its verdict on these cases and ruled that there is no objection for implementing reservation to Other backward classes (OBCs). It also directed the Director General of Health services to constitute a committee comprising of the representatives of the Government of Tamil Nadu, Medical Council of India and Dental Council of India to formulate the methodologies for implementing reservations.

After the enactment of the Central Educational Institutions (Reservation in Admission) Act 2006, reservation 27% of seats in admissions to UG and PG medical seats in Central Government medical colleges has been provided since the year 2010-11. The Directorate of Health Services is the sentinel body that handles admissions to Central Government medical institutions. The same directorate also coordinates admissions to UG and PG courses under ALL INDIA QUOTA. I wish to bring to your kind notice that there cannot be any valid reason why reservation should not be provided for seats under ALL INDIA QUOTA.

All India Quota is formed by pooling 50% of PG seats and 15% of UG seats in various state governments’ medical colleges. Since all the seats are government educational institutions’ seats pooled from State governments, the 27% reservation must be implemented as per the law of the land. While reservations for other categories like SCs, STs are implemented as per rule book and Economically Weaker Sections (EWS) are provided reservation within general category, refusing OBCs alone their due right is injustice and discrimination.

This indifferent attitude of the Directorate of Health Services has done huge harm to the interests of OBC students. In the past 4 years alone 11,000 OBC students have lost their right to get admitted to UG and PG medical courses under All India Quota. Other backward classes (OBCs) have been denied their constitutionally provided rights for more than three decades. I plead the Honourable Prime Minister to immediately put an end to this injustice.

Hence I submit that the Honourable Prime Minister to use his good offices to take necessary steps to ensure compliance of the Court verdict and implement the 27% reservation to OBCs in admissions to UG and PG medical courses. I will be extremely thankful if the Honourable Prime Minister may ask those concerned to immediately convene a meeting of the Secretary of the Department of Health, Government of Tamil Nadu, Secretary of the Medical Council of India and the Secretary of the Dental Council of India under the auspices of the Director General of Health Services to work out the modalities of implementation of OBC reservation without any further delay.

அன்புள்ள பாரதப் பிரதமர் மாண்புமிகு நரேந்திர மோடி அவர்களுக்கு,

பொருள்: மருத்துவப் படிப்புக்கான அகில இந்திய தொகுப்பு இடங்களில் பிற பிற்படுத்தப்பட்ட வகுப்பினருக்கு இட ஒதுக்கீடு வழங்குதல் & சென்னை உயர்நீதிமன்ற தீர்ப்பை செயல்படுத்தக் கோருதல் & தொடர்பாக
மருத்துவக் கல்வி மாணவர் சேர்க்கைக்கான அகில இந்திய தொகுப்பு இடங்களில் பிற பிற்படுத்தப்பட்ட வகுப்பினருக்கு தொடர்ந்து 30 ஆண்டுகளுக்கு மேலாக இழைக்கப்பட்டு வரும் அநீதியை களைவதற்கு தங்களின் நடவடிக்கையை எதிர்பார்த்து இந்தக் கடிதத்தை எழுதுகிறேன்.

இந்தியாவின் பிரதமராகிய தாங்களும் பிற்படுத்தப்பட்ட சமுதாயத்தைச் சேர்ந்தவர்கள் என்பதால், பாதிக்கப்பட்ட மாணவர்களின் உணர்வுகளை புரிந்து கொள்ள முடியும்; உங்களால் அவர்களுக்கு நீதி பெற்றுத் தர முடியும் என்ற நம்பிக்கையில் தான் இந்த கடிதத்தை தங்களுக்கு நான் எழுதுகிறேன்.

பாட்டாளி மக்கள் கட்சி சமூகநீதிக்காக பாடுபடும் கட்சி என்பதை தாங்கள் அறிவீர்கள். மாநில அளவிலும், தேசிய அளவிலும் சமூகநீதியைக் காப்பதற்காக பாட்டாளி மக்கள் கட்சி தொடர்ந்து பாடுபட்டு வருகிறது. மருத்துவக் கல்விக்கான அகில இந்திய ஒதுக்கீட்டு இடங்கள் உருவாக்கப் பட்ட நாளில் இருந்து, மாணவர் சேர்க்கையில் பிற பிற்படுத்தப்பட்ட வகுப்பினருக்கு இட ஒதுக்கீடு மறுக்கப்பட்டு வருகிறது. இது குறித்து மத்திய சுகாதாரத்துறை அமைச்சர் அவர்களுக்கு பா.ம.க. இளைஞரணித் தலைவரும், மத்திய சுகாதாரத்துறையின் முன்னாள் அமைச்சரும், மாநிலங்களவை உறுப்பினருமான மருத்துவர் அன்புமணி இராமதாஸ் அவர்கள் பல முறை கடிதம் எழுதியுள்ளார்.

அதுமட்டுமின்றி, மருத்துவக் கல்விக்கான அகில இந்திய ஒதுக்கீட்டு இடங்களில் பிற பிற்படுத்தப் பட்ட வகுப்பு மாணவர்களுக்கு 27% இட ஒதுக்கீடு வழங்க வேண்டும் என்று ஆணையிடக் கோரி சென்னை உயர்நீதிமன்றத்தில் மருத்துவர் அன்புமணி இராமதாஸ் அவர்களும், வேறு பல கட்சிகளைச் சேர்ந்தவர்களும் வழக்குத் தொடர்ந்தனர். அந்த வழக்கில் நேற்று தீர்ப்பளித்த உயர்நீதிமன்றம், ‘‘அகில இந்திய தொகுப்பில் பிற பிற்படுத்தப்பட்ட வகுப்பினருக்கு இட ஒதுக்கீடு வழங்குவதற்கு எந்தத் தடையும் இல்லை. பிற பிற்படுத்தப்பட்ட வகுப்பினருக்கு இட ஒதுக்கீடு வழங்குவதற்கான வழிமுறைகள் குறித்தும் விவாதிக்க தமிழ்நாடு அரசு, இந்திய மருத்துவக் கவுன்சில், பல் மருத்துவக் கவுன்சில் ஆகியவற்றின் பிரதிநிதிகள் அடங்கிய குழு அமைக்க வேண்டும்’’ என்று ஆணையிட்டுள்ளது.

மத்திய கல்வி நிறுவனங்கள் (மாணவர் சேர்க்கையில் இட ஒதுக்கீடு) சட்டம் – 2006 நிறைவேற்றப் பட்ட பிறகு 2010&11ஆம் ஆண்டு முதல் மத்திய அரசின் உயர்கல்வி நிறுவனங்களில் பிற பிற்படுத்தப் பட்ட வகுப்பினருக்கு 27% இட ஒதுக்கீடு வழங்கப்பட்டு வருகிறது. மத்திய அரசின் மருத்துவக் கல்வி நிறுவனங்களுக்கான மாணவர் சேர்க்கையை நடத்தும் சுகாதார சேவைகளுக்கான தலைமை இயக்குனர் அலுவலகம் தான், அகில இந்திய தொகுப்புக்கான இடங்களுக்கும் மாணவர் சேர்க்கையை நடத்துகிறது. அவ்வாறு இருக்கும் போது அகில இந்திய தொகுப்பு இடங்களுக்கு மட்டும் பிற பிற்படுத்தப்பட்ட வகுப்பினருக்கு மட்டும் 27% இட ஒதுக்கீடு மறுக்கப்படுவது எந்த வகையிலும் நியாயமில்லை என்பதை தங்களின் கவனத்திற்கு கொண்டு வருவதற்கு விரும்புகிறேன்.

அகில இந்திய ஒதுக்கீட்டு இடங்கள் தனியாக உருவாக்கப்படுவதில்லை. நாடு முழுவதும் உள்ள அரசு மருத்துவக் கல்லூரிகளில் உள்ள மருத்துவ மேற்படிப்பு இடங்களில் 50% இடங்களும், இளநிலை மருத்துவப் படிப்புகளுக்கு மாநில அரசு மருத்துவக் கல்லூரிகளில் இருந்து 15% இடங்களும் ஒதுக்கீடு செய்யப்படுவதன் மூலம் தான் அகில இந்திய ஒதுக்கீட்டு தொகுப்பு உருவாக்கப்படுகிறது. அவையும் அரசு மருத்துவக் கல்லூரி இடங்கள் தான் எனும் போது, அவற்றில் பிற பிற்படுத்தப்பட்ட வகுப்பினருக்கு 27% இட ஒதுக்கீடு வழங்கப்பட வேண்டும். அது தான் உண்மையான சமூகநீதியாக இருக்கும். மற்ற இட ஒதுக்கீட்டுப் பிரிவினர் அனைவருக்கும் உரிய இட ஒதுக்கீடு வழங்கப்படும் போது, பிற பிற்படுத்தப்பட்ட வகுப்பினருக்கு மட்டும் இந்த உரிமை மறுக்கப்படுவதை ஏற்றுக்கொள்ள முடியாது.

அகில இந்திய தொகுப்பு உருவாக்கப்பட்ட நாளில் இருந்து பிற பிற்படுத்தப்பட்ட வகுப்பினருக்கு இட ஒதுக்கீடு வழங்கப்படாததால், அந்த வகுப்பைச் சேர்ந்த மாணவர்கள் கடுமையாக பாதிக்கப் பட்டுள்ளனர். அகில இந்திய தொகுப்பில் இட ஒதுக்கீடு மறுக்கப்பட்டதால் கடந்த 4 ஆண்டுகளில் மட்டும் 11,000 மாணவர்கள் இளநிலை மற்றும் முதுநிலை மருத்துவம் பயிலும் வாய்ப்புகளை இழந்து விட்டனர். 35 ஆண்டுகளாக உரிமைகளை இழந்த பிற பிற்படுத்தப்பட்ட வகுப்பு மாணவர்கள் இனியும் பாதிக்கப்படக்கூடாது. அதை மாண்புமிகு பிரதமர் அவர்கள் உறுதி செய்ய வேண்டும்.

எனவே, சென்னை உயர்நீதிமன்றம் அளித்தத் தீர்ப்பின்படி அகில இந்திய தொகுப்பு இடங்களில் பிற பிற்படுத்தப்பட்ட வகுப்பினருக்கு உடனடியாக இட ஒதுக்கீடு வழங்க நடவடிக்கை மேற்கொள்ள வேண்டும். அதற்கு வசதியாக தமிழக அரசின் சுகாதாரத்துறை செயலாளர், இந்திய மருத்துவக் குழுவின் செயலாளர், இந்திய பல் மருத்துவக் குழுவின் செயலாளர்கள் கூட்டத்தை சுகாதார சேவைகளுக்கான தலைமைச் செயலாளர் மூலம் நடத்தி, உரிய முடிவுகளை எடுக்கும்படி சம்பந்தப்பட்ட அனைவருக்கும் உரிய ஆணைகளை பிறப்பிக்கும்படி பிரதமர் அவர்களைக் கேட்டுக் கொள்கிறேன் என்றும் அவர் அந்த கடிதத்தில் தெரிவித்துள்ளார்.
